On one occasion, Nasreddin borrows a kazan (large cauldron) from his neighbor. When Nasreddin returns the kazan, the neighbor sees that there is a small cooking pot in the bottom. He asks Nasreddin: "What is this?" Nasreddin replies: "Apparently the kazan had been pregnant and it has given birth to this small pot." The neighbor unquestioningly accepts the kazan and the pot. Some weeks later, Nasreddin wishes to borrow the same kazan. The neighbor is only too happy to oblige. This time, a month passes. The neighbor calls on Nasreddin to inquire about his kazan. Nasreddin, with a concerned look, announces: "I am sorry, but your kazan died." The neighbor is puzzled. Then becoming angry, he demands: "How could it die?" Driving through the low plains which led out of Denver, Colorado I noticed a certain change in the scenery. Steven, you should DEFINITELY continue to give your life to . . . literary novels (notice I omitted “obscure”).  What you have produced is a phenomenal work.  Others, in the past, have attempted to do something like you have done, but they did not come close to creating a work with such breadth and depth as you.   I apologize for taking so very long to complete the reading of your work, but it is very densely written in some sections, while others seem to be as lucid as anything I have ever read.  Your vocabulary probably exceeds my own (“fulgurant”), for which I am thankful, as I always enjoy being taught the existence of words I have not yet incorporated into my own lexicon.   The most successful parts of your work—for me—were the interactions between Luk, Aus, and the central character, as those passages moved the story along.  I think using the unrest and waging of police action in Bangkok sets up the intellectual discontent in the rest of the novel, but I would wish for a more balanced unfolding of the story with the intellectual ruminations.  The least successful passages for me were sometimes extremely lengthy sen...

Even where the user has made a reasonably diligent effort to find the owner, if the owner is not found, the user faces uncertainty – she cannot determine whether or under what conditions the owner would permit use. Where the proposed use goes beyond an exemption or limitation to copyright, the user cannot reduce the risk of copyright liability for such use, because there is always a possibility, however remote, that a copyright owner could bring an infringement action after that use has begun....

Many commenters were in favor of determining whether a search was reasonable on an “ad hoc” or case-by-case basis, whereby each search is evaluated according to its circumstances. This approach was offered as having the advantage of flexibility to cover the wide variety of situations that depend on the type of work and type of use involved.
